Gift Certificate and Voucher Terms and Conditions

Effective Date: January 1, 2023

These Gift Certificate and Voucher Terms and Conditions (“Gift Certificate and Voucher Terms”) govern your use of Canadian Coastal Sailing Gift Certificates ("Gift Certificates") or Canadian Coastal Sailing Vouchers ("Vouchers") on the Canadian Coastal Sailing Website. Your use of Gift Certificates or Vouchers and the services available via the Canadian Coastal Sailing Website shall be subject to Canadian Coastal Sailing's Terms of Service (“Terms”); if you see an undefined term in these Gift Certificate and Voucher Terms, it has the same definition as in the Terms.

Claiming and Redemption of Gift Certificates

You can redeem a Gift Certificate by visiting canadiancoastal.com. Gift Certificate balances may only be redeemed toward the purchase of eligible goods and services provided by Canadian Coastal Sailing. Any booking made with a Gift Certificate will be deducted from your Gift Certificate balance, and any unused Gift Certificate balance will remain on your Canadian Coastal Sailing account until used. If a purchase exceeds your existing Gift Certificate balance, the remaining amount due must be paid with another payment method.

No fees of any kind apply to Gift Certificates, and Gift Certificates and Gift Certificate balances do not expire. These Gift Certificate and Voucher Terms remain applicable until your entire Gift Certificate balance has been spent.

Claiming and Redemption of Vouchers

You can redeem a Voucher by visiting canadiancoastal.com. Vouchers may only be redeemed for the quantity of applicable goods or services specified by the Voucher and provided by Canadian Coastal Sailing. Once a Voucher is used for a purchase, the Voucher is considered fully redeemed.

No fees of any kind apply to Vouchers. Vouchers are associated with a specific quantity of goods or services, and may expire if the good or service is no longer offered, or if the redemption period has expired. These Gift Certificate and Voucher Terms remain applicable until your entire Voucher balance has been redeemed, the applicable goods or services are no longer offered, or the redemption period has expired.

Limitations

Gift Certificates and Vouchers are purchased in Canadian dollars, and Gift Certificates are redeemed in Canadian dollar amounts.

Gift Certificates and Vouchers may not be applied toward charges for changes to existing reservations or be used to purchase other Gift Certificates. Gift Certificates or Vouchers cannot be reloaded, resold, transferred for value or redeemed for cash, except to the extent required by law. Gift Certificates or Vouchers cannot be transferred to another person.

Risk of Loss

You should treat Gift Certificates and Vouchers like cash. Once we electronically transmit a digital Gift Certificate or Voucher to the purchaser or designated recipient, or deliver a physical Gift Certificate or Voucher to the carrier, whichever is applicable, the risk of loss and title for Gift Certificates or Voucher pass to the purchaser. We are not responsible if any Gift Certificate or Voucher is lost, stolen, destroyed, or used without your permission.

Fraud

Canadian Coastal Sailing reserves the right to any remedy, including refusal to issue or honour a Gift Certificate or Voucher, in the event of suspected fraud. We will have the right to charge alternative payment methods if a fraudulently obtained Gift Certificate or voucher is redeemed and/or used to make purchases on the Canadian Coastal Sailing website.

Limitation of Liability

To the maximum extent permitted by law, we make no warranties, express or implied, with respect to Gift Certificates and Vouchers, including without limitation, any express or implied warranty of merchantability or fitness for a particular purpose. To the maximum extent permitted by law, in the event a Gift Certificate or Voucher is non-functional, your sole remedy, and our sole liability, will be the replacement of such Gift Certificate or Voucher. Certain laws do not allow limitations on implied warranties or the exclusion or limitation of certain damages. If these laws apply to you, some or all of the above disclaimers, exclusions, or limitations may not apply to you, and you may have additional rights.

These Gift Certificate and Voucher Terms are governed by and construed in accordance with British Columbia Law, and your purchase, receipt, and/or redemption of a Gift Certificate or Voucher is subject to British Columbia law.

Canadian Coastal Sailing may modify these Gift Certificate and Voucher Terms at any time. When we make material changes to these Gift Certificate and Voucher Terms, we will post the revised Gift Certificate and Voucher Terms on the Canadian Coastal Sailing website and update the “Effective Date” at the top of these Gift Certificate and Voucher Terms. All terms and conditions are applicable to the extent permitted by law.

Changes made to these Gift Certificate and Voucher Terms may be in respect of: (i) the claiming and redemption of Gift Certificates and Vouchers; (ii) limitations of use of Gift Certificates and Vouchers; (iii) risk of loss or fraud; (iv) limitation of liability; (v) resolution of, or any claim related to, disputes; or (vi) the general terms including modifications, governing law and jurisdiction, and definitions.
